Answers from Our San Francisco Personal Injury Lawyer

Do I have grounds to file a personal injury claim?

Your right to pursue monetary damages in a personal injury or wrongful death claim depends on your ability to prove that the accident was caused by the defendant's negligent actions or omissions. If the other party was at fault for causing the accident, you are most likely entitled to claim financial compensation.

How will you prove my case?

Proving that the other party is responsible for causing your injuries or the death of a loved one involves producing evidence that he or she committed some type of careless or reckless action or failed to take reasonable precautions to avoid the accident. A common example would be a car accident caused by a drunk driver or a driver who was texting on a cell phone. Another common scenario is a slip and fall that could have been prevented by cleaning a spill on the floor. It is also possible to sue a manufacturer for negligence in manufacturing or selling a dangerous or defective product, a type of claim which is referred to as product liability.

Will my case go to trial?

Whenever possible, we attempt to settle our clients' claims out of court, since this is typically a faster way to resolve the case. If, however, the insurance company or other defendant refuses to pay you the amount you deserve, we will not hesitate to take your case all the way to a jury trial in pursuit of the full compensation you deserve. This approach has succeeded in making it possible for us to win more than $350 million for our clients.

What can I receive if I win?

When we meet with you for a free case evaluation, we will take the time to review every aspect of the impact which your accident has had on your life, in order to determine the full scope of how much your case is worth. Your claim for damages can include the costs of all your medical expenses for hospitalization, surgery, rehabilitative care and any medication or equipment you may need to accommodate your disability. You can also receive economic damages for your lost wages and reduced earning capacity. In addition, you can demand noneconomic damages to compensate you for your pain, suffering and emotional distress, or for loss of companionship in the case of a wrongful death claim.

Should I accept a settlement from the insurance company?

It may happen that the insurance company approaches you with an offer to pay you for your claim in exchange for settling your case. Do not accept the offer before first consulting with a San Francisco personal injury lawyer at the Law Offices of Steven A. Fabbro. You cannot trust the insurance company to treat you fairly or to offer you the full amount that you deserve for your losses, since their primary concern is to protect the bottom line. Let us review your case to determine how much you are entitled to receive in damages and advise you of your options for pursuing legal action!
